A teenager rapes a very young boy - He gets off WITHOUT a custodial sentence. A few days later he rapes a 5 year old boy and then gets an ' indefinite ' sentence which I understand to be at least 3, yes, THREE years.

I always understood that ' three' came after ' two ' which was ' one' more than a single unit ie 3 is 1 + 1+ 1 or have I got this wrong ?

Of course, with suitable treatment and a hug from Dr J he would be cured- HURRAH !!!

loser try this one. An 8 year old boy is **sexually raped by someone living in his street. The CPS decide not to prosecute for lack of evidence. Injuries confirm it took place. And council do not want to move victim to new home. It actually happened!

Judges have to follow sentencing guidelines so perhaps it is wrong to jump to the conclusion that this judge is a senile old fart who ought to know better.
Report Dr Crippen November 11, 2009 5:47 PM GMT
In sentencing for the first rape, Judge Smith is believed to have considered the victim's family, who forgave the youth because of their Christian beliefs.

Stroll on whats that got to do with it?

The three-year community order led to an appeal by the Crown Prosecution Service (CPS), but was overtaken when, just days after appearing in court, he was arrested for the second rape.

Well I certainly hope the judge gave him a darn good talking to.
Report Dr Crippen November 11, 2009 5:53 PM GMT
If he had been birched for the first offence I doubt if the second offence would have taken place.

In fact Im sure it wouldn't.

why not just put the rubber ring round his knackers crippen?
Report Dr Crippen November 11, 2009 6:09 PM GMT
Yes they could do that as well to make sure.

An acknowledgement that the input of the aggrieved is rarely helpful in determining sentence?

Interesting, Blackie would enjoy reading this:

http://www.corpun.com/manx.htm

I read an article somewhere written by an IOM police officer regarding the people he had birched.
He mentioned that he couldnt recall anybody coming back for a second dose.
That sounds about right.

I dont think an "indefinite" sentence means anything. Its about as light a sentence as you can get.
Report alfie255 November 11, 2009 10:12 PM GMT
Quelle surprise....the right are always willing to spout off about the feelings of victim's families when they share their bloodthirst- any deviation from this and it goes out of the window.
Report enpekd November 11, 2009 10:13 PM GMT
if this sicko returns to the community, he will find another vunerable young soul.......
then he may get a life(12 year) sentence
then no doubt , he will get a new identity and at the taxpayers expense be a free "man" to roam around another unsuspecting town or city

Whats going on?
Report epicurean November 11, 2009 10:15 PM GMT
It means a psycologist is conned by the offender that he is not a threat to society . Released and do the same thing again murders etc . Happened many times.

Thanks crippen.

To be honest I'm against caning of youngsters, basically because I dont think you should cane boys but not girls, and somehow beating girls is a bridge too far for me. All the same, corporal punishment is a great idea.

Loser , you are right to be indignant, but wrong to bring a fellow poster into your argument just because YOU don't agree with him, you have shown this trait before so you have chosen the right nom de plume for yourself.
Report Big Charlie November 12, 2009 8:20 AM GMT
Somebody on chit chat reported that the teenager has *Aspergers Syndrome.

Not that I understand AS to any degree, what he did was obviously horrific, but in all probability, he doesn't know that it was wrong.

Couple that with the fact that the first victims family are christians, and they said they were prepared to forgive him.

The Judge made his recommendations based on these facts.

* I know somebody whose 7 year old son has AS. He concluded that the dog needed washing after running through mud in the local park, so he put it in the washing machine.

Can anybody conceive of any circumstances, in which a person should be allowed to walk from a court with only a community order, after being convicted of raping a seven-year-old boy?

I cant crippen, but the usual suspects advocating rehabilitation and medical help will be along soon.

Certain aspects of sharia law are very appealing in cases like this

meanwhile this is what Liar Party MPs are worrying themselves with

'Gay people face the risk of greater attack if the House of Lords continues to block a Bill banning "**phobic hatred", former minister Lord Smith has warned.

Tory peers last night defeated the Government over the issue, insisting that it was important to protect free speech.

Labour MPs vowed to overturn the defeat today when the amendment to criminalise criticism of "sexual conduct and practice" returns to the Commons.'
