Yes, the changing room incident was childish and rude. But, did that justify a 10 month forced absence from riding? of course not.

Let's move on. The bookies have been bullying us for years now eg bet restriction/account closure yet the BHA has done sweet-fa. A double standard yet again displayed by the supposedly authority of horseracing. What a let down!

Nothing has upset me or haven't you read my last post. I haven't posted anything on here about the whole affair as I'm not bothered to post about such a thing, apart from articles relating to it. All I'll say there was an independent disciplinary panel and the findings were or should have been an embarrassment to Dunne. He didn't come across as a particularly nice person and the appeal hearing also bears that out. And reading about the appeals panel it seems a bit of the old schoolboy network came into force. But you can argue as much as you like and make as many excuses as you like but Dunne was found guilty, end of. That was my only interest in the case. I was only interested in the facts not my personal opinion which I could only base on what I read about the actual case and not on this forum.

Report Try My Best March 31, 2022 7:19 PM BST
Towards the end of the morning session in Robbie Dunne's appeal against the 18-month suspension given to him over his conduct towards fellow rider Bryony Frost, BHA barrister Louis Weston QC and panel chair Anthony Boswood QC debated some of the language allegedly used by Dunne.

Dunne, who it had been claimed called Frost a "f****** ****" and a "dangerous c***", was challenging the punishment handed to him at the end of last year for subjecting Frost to a protracted bullying campaign.

In this particular exchange, Weston attempted to persuade Boswood that words spoken by Dunne following a race at Stratford in July 2020 were indefensible.

Robbie Dunne ban for bullying Bryony Frost reduced to ten months on appeal

Anthony Boswood: We can't really differentiate between one sort of bad language and another, can we?

Louis Weston: Yes, we can, with respect.

AB: On the specific words?

LW: Calling a woman "a ****", yes, is just frankly unacceptable.

AB: Is it worse than calling a man "a c***", is it?

LW: Yes. Yes.

AB: It's not because of the gender element, is it?

LW: Yes. It's suggesting that she is promiscuous.

AB: Well, calling someone "a bastard" suggests he's illegitimate. Albeit it's offensive and deeply unattractive and so on and so forth, but one has to distinguish, surely, fairly, between the spur of the moment, when one is angry, legitimately or not, and the cold light of day, as it were?

LW: This wasn't, with respect, heat of the moment. The incident Mr Dunne was complaining of happened in the early stages of the race. He has then completed the race, come over to her and used that language to her.

AB: He could hardly use that or any other language going over the water jump, could he?

LW: You are, with respect, moving from one line of attack on me to another. The first line of attack is to say it's heat of the moment, and I explained to you why it's not. The second is to say it would be impossible for him to remonstrate with her during the race. I don't know, but he didn't. He waited until after, went over to her and abused her in that way. There's not a single workplace in this country where you can use that language to a woman and stay in your job. You just can't do it. It's unacceptable. It's objectively unacceptable. If you don't agree with me about that, the proper test at the moment is whether it was reasonable of the panel to reach a view that it was unacceptable, having heard Mr Dunne concede that it was. There are some terms – some racist language, some gender-based slurs, some sexuality-based slurs – that in contemporary understanding are simply unacceptable.

AB: Under any circumstances?

LW: Under any circumstances. However angry you are, you cannot use certain language. It's not an excuse, it's not a defence.

Some fair points raised by the Panel Chair imo.
Report impossible123 March 31, 2022 7:47 PM BST
LW was made to look a tool in that exchange, I'm afraid to say. Where did the BHA get him from? I'm sure there is a more competent and "common" QC in the business.
Report impossible123 March 31, 2022 8:39 PM BST
Just read Lydia's report of the proceeding. The QC for the BHA was dealt a googly throughout - he did not have a leg to  stand on; Panel Chair was "siding" with Defence Council. As such, the inevitable reduction in punishment.

Nevertheless, I believe the original punishment was too severe and did not fit the crime.

Since 2018, Robbie has had only one ride in Ireland, and that was for Neil Mulholland (2/3/20 on Scardura). In the same time, Bryony has had six. It seems neither of them would be missed from the Irish racing scene if both were to retire tomorrow.

Maybe thats because Dunne was working in the U K since 2008 and bryonys rides were mainly for english trainers sending horses over to ireland .

A lot has been said and written about this case but it boils down to one over-riding thing, Bryony Frost is largely disliked by her fellow weighing room colleagues and by many onlookers alike and for this reason Dunne was allowed to treat her as he did with little or no intervention.

Ask yourself if a jockey had allowed his jealousy to boil over at someone like Rachael Blackmore, how far would he have got?

Robbie Dunne has admitted to one charge of acting in a violent or improper manner towards Bryony Frost in the first day of his British Horseracing Authority hearing.

The jockey has admitted a breach of Rule (J) 20, acting in a violent or improper manner towards Bryony Frost. This was in relation to a race at Southwell on 3 September 2020.

Dunne is alleged to have told her he would "murder" her, in return for her "murdering" him - a reference to dangerous riding which can be used in horseracing.
Report irishone April 1, 2022 7:56 PM BST
The panel was then shown a replay of the race on 8 July 2020 at Stratford, after which Frost alleged that Dunne told her: "If you ever murder [cut across] me like that again, I will murder you".

Dunne denies saying this.

Watching the race, Dunne said: "Miss Frost comes from the middle of the track, makes a beeline for the rail, I had to cut back. She has no awareness for others around her, no awareness for the safety of others around her. She's renowned for doing it."

Last week, a fence attendant alleged he'd heard Dunne abusing Frost that day in a "very personal, very aggressive" manner.

The panel was shown footage of the area where the horses pull up after the race, and Dunne said the unnamed fence attendant was "nowhere to be seen".
Report irishone April 1, 2022 7:59 PM BST
Hardly surprising as in the pulling up area there is no need for fence attendants !

Robbie Dunne's alleged verbal attack on Bryony Frost at Stratford last year would have been reported immediately to officials if the extent of their feud had been known by a male fence attendant who allegedly heard the abuse, such was its ferocity, he told a disciplinary panel hearing on Thursday.

The fence attendant, whose name was kept private, described Dunne allegedly calling Frost a "f****** s***" as a "whoa moment" that he had not experienced before on a racecourse during his testimony at a hearing brought by the BHA against Dunne on charges of prejudicial conduct and violent and threatening behaviour. He denies all charges of prejudicial conduct and two of the three of threatening behaviour.

The volley of alleged abuse directed at Frost was "out of the ordinary", according to the male fence attendant, who queried why other riders, who had been "within earshot", had chosen not to appear as witnesses.

"There were other jockeys in what I would call earshot – I think it's a significant point to me that they have not come forward as witnesses," he said.

It was put to the male fence attendant by Roderick Moore, representing Dunne, that Adam Wedge, who had been present, described the exchange as "nothing out of the ordinary" and that he had not seen any evidence of Frost being bullied.

The male fence attendant said: "That's between him and his conscience. My conscience is clear and I know what was said and the manner it was delivered. In my experience of the racecourse this was very out of the ordinary.

"What would be ordinary to him might be very different to what might be ordinary to members of the public. To me it was a long sentence and the volume and level of aggression was raised and he spat out those three words that I listed."

He added: "It was a 'whoa' moment. We didn't realise there was trouble between these individuals. If we did we would have reported it immediately. This was something different."
Report irishone April 1, 2022 8:08 PM BST

I get the feeling even if this had been dealt with well by the BHA I suspect Bf wouldn't be happy and I do wander if any 'pr' people advised her (badly).
When you basically have 1 person saying 1 thing and pretty much everyone else saying at least 'it wasn't quite like that' and those  people's evidence is labelled trustworthy (so the entire weighing room) it isn't surprising she aint the most popular, even to those that supported her as best they could.

As such would be deemed unsatisfactory witness in any law court in the country; no dispute about Mr Dunne's inappropriate and at times intimidating behaviour. Nevertheless, the original sentence was excessive and wholly unjust. I've not read one present NH jockey criticising Mr Dunne vehemently; Motterhead's - an employee of the RP - has led the RP into a spiral decline thus not qualified to judge objectively and intelligently.

Mr Dunne is serving a 10 month ban; the Appeal proceeding was not his doing. Let's move on. Horseracing is not just about a couple of jockeys who did not get on for reasons specific to them - rightly and wrongly. What other professions do not eg economists?

I notice that Lorcan Williams was on her pre-published ride Hitman today.  Was the female jockey stood down after her fall yesterday?  At least she doesn;t miss a ride in the National - she didn;t have one!
She wasn't fit at Ayr and shouldn't have been allowed to ride.

According to the Sun:-

BRYONY FROST has been ruled out of the remainder of the Grand National meeting after a heavy fall on Thursday.
