worrying times for GE. if the Mail had doubts about it's authenticity they would surely have not have published - and would certainly have taken it down. otherwise the tabloids would just post fake photos of celebs and little else.

That was my opinion ages ago but they obviously prefer insulting each other.

It won't though, 1st time Poster. They will just say "well, it could have been real" And on they go with no comeback and nobody holding them to account. I remember the scummy Daily Mirror posting a picture on their front page after a lovely old horse of Micheal Bell's broke down in a Flat race. It was just an accident but that didn't stop the DM printing the picture and thus getting its Lab/Lib readership whipped up into a frenzy. Now the same kind of people have gone beyond this and are actually create fake pictures for maximum exposure. Absolutely disgraceful.

if it's fake it's a clear case of defamation - Elliot should clean up in court

"Surely" - If the standard of mainstream journalism the past few years is anything to go by I wouldn't be surprised at all.

I'm not aware of many fake photos being published that are defamatory in nature

that won't wash in court if GE pursues defamation

Is it known who first published the photo ;if so then surely that is the organisation GE could  sue for libel assuming of course it's a faked photo.

but did it identify and defame specific individuals?

in GE's favour the horse doesn't look like a racehorse in training - why would it have been lying dead on a trainer's AW gallops?

If the photo was at any point stated to be fact by the mail and subsequently found to be fake,it is libel i.e defamation of GEs character.

So what do the racing authorities do if Gordon just simply says through his legal team "i do not recall that photo/situation"?

Elliott looks about 15 years younger and what about what is actually going on in the picture, he is representing a moment of levity with the V sign and an apparent grin on his face.

So we are led to believe that at the moment of such sadness, Elliot is supposed to have said, come on lads get the phone out and take a picture of this!!!

Has to be total nonsense.

No saddle on it, so not a horse being trained....I guess it was just some random horse that walked around the gallops there. Like I said, you have to be as thick as 2 short planks to think the picture is real.

Trawling through the mire that is twitter and taking in all premature conclusions, I have decided the answer is a disgruntled former employee has done something very stupid by creating this picture and that Gordon has to keep tight lipped for now to achieve the best possible outcome in going after him/her on defamation/whatever charges. I'm treating this as fact until the facts arrive.

And of course we have the coincidence that it has come to light right on the eve of the festival.

If it was real you'd have to question the participation of his horses because his owners would immediately have to take them away to new homes which would be a right old mess!!!

james,

How so? my opinion was that I didn't believe the photo, then someone is suggesting that he has admitted it. On that basis there should be no excuse for it and he should suffer accordingly...pretty clear I thought.
