Delia Bushell's troubled tenure at the head of the Jockey Club has ended in extraordinary and sensational circumstances after an independent barrister upheld allegations centred around the bullying of colleagues, the use of racist comments and sharing offensive material.

"As part of this review, an independent barrister interviewed 19 witnesses, including Delia. He submitted a detailed report to a sub-committee of the board comprising Dido Harding, Julia Budd and Justin Dowley on Sunday 23rd August, in which he concluded that there was evidence to support a number of the allegations of misconduct, including bullying behaviour towards colleagues, inappropriate racist comments and sharing offensive materials.

Delia Bushell's resignation letter in full
Dear Board of Stewards,

I am writing to convey my sense of shock and sadness at my treatment by the Jockey Club, and to tender my resignation with immediate effect.

I was appointed into a highly challenging change-agent role in an organisation and industry that is deeply resistant to change. As our Board of Stewards, you were clear in your instructions to me, repeatedly, that I deliver rapid transformation, despite unsuccessful attempts by the Board to engender this in recent years, and then despite the additional headwinds created by the Covid crisis. When I arrived in Autumn 2019, Sandy Dudgeon instructed me to make an immediate change in ‘tone and pace’ both internally and externally. I was regularly congratulated by the Board on the quality of strategic work being produced and told that, if I was ruffling feathers as we progressed, that usually meant I was “doing the right thing”.

In July, as we began to implement a full restructure of the business, an employee whose role is impacted by the proposed restructure raised a grievance against me, with 22 allegations encompassing everything from victimisation to a lack of phone calls from me. You instructed a supposedly independent barrister to look into these, and then this confidential matter was leaked to the press from within the Jockey Club, with clear intent to undermine my position and harm me.

This grievance process, and the management of the broader situation created by it, have been fundamentally mishandled by the Board of Stewards. The Board’s engagement with me has been disingenuous and focused on protecting its own interests at my expense.

The Board purports to be upholding fairness in its management of the grievance, but this is not the case: the process followed was both flawed and biased. There is nothing fair about a process in which the testimony of myself and my witnesses is largely disregarded or discredited on the grounds that they “may not be objective”, while the evidence of collusion by a number of male witnesses, all senior executives in the Jockey Club, both ahead of the filing of the grievance and during the investigation process itself, is ignored by your barrister.

Several witnesses contacted me to express their concerns about the barrister’s lack of impartiality and their impression that the line of questioning was designed to achieve a particular outcome. They suggested that the process appeared a deeply unpleasant ‘stitch up’ and advised that I walk away from the Jockey Club immediately.

Your barrister’s conclusions also seem designed to eliminate any reference to, or criticism of, the role that the Board of Stewards itself has played in creating the conditions in which this grievance was raised, or of the previous failures of various Board members to protect me in the face of discriminatory behaviour towards me. In the investigation interview itself, the barrister told me that he had been instructed by Julia Budd to ‘keep the Board of Stewards out of it’, and that I could not call on Board members as witnesses. In the conclusions section of the investigation report, any piece of evidence related to a member of the Board, however material it was in evidencing the facts or context of events, has been ignored. This includes, for example, the Board members’ own repeated criticisms of members of the JCR Board and of the prior Group and JCR CEOs, and instructions to more proactively performance manage JCR Board members, or indeed to discipline or ‘remove’ them. Also entirely absent from the report’s conclusions is any mention of the evidence I supplied of the Jockey Club’s extensive history of staff raising grievances, and of a male-dominated organisation that has a troubling history of ignoring serious complaints against senior men and which seeks to discredit and ostracise anyone challenging its status quo.

The supposedly confidential scrutiny of this grievance was breached just before your barrister delivered his conclusions with a leak of information about this matter to the Sunday Times and, shortly before, to the Racing Post. Tellingly, your public relations strategy included withholding from me any communication from the Sunday Times, even though that newspaper’s journalist had emailed a request to share her communication with me. On learning of this, you instructed me not to defend myself against the leaked allegation.

I have been subjected to unmerited, dishonourable, bullying behaviour by people I previously held in high regard and trusted. I clearly cannot rely on the trust and confidence of the Board, which has once again allowed the long-standing discriminatory undertones of the Jockey Club to prevail. Given the toxicity of the working environment I find myself in, the predetermination of the disciplinary and the clear and ongoing threats to my reputation, I have no choice but to accept the repudiatory conduct described in this letter and to resign with immediate effect. I reserve all of my rights.

I note that this report did not uphold the complaint of bullying, nor of 15 other allegations. I do not accept the barrister’s findings in relation to the other allegations.

I hope the Board of Stewards will reflect at length on their conduct during this sad process, on the culture they have presided over at the Jockey Club for many years, and on the impact created by their mismanagement of a collusive series of allegations by someone who felt threatened by a change management process that they themselves had required. While I do not claim to be perfect in all that I have done, nothing in my conduct has merited what I have experienced over the past two months and it causes me sadness that I will no longer have the opportunity to support and mentor some of the excellent colleagues that I have had the opportunity to work with over the past year.

I hope that the next Jockey Club Group CEO receives the real support they need to deliver this programme of much-needed change.

she ' big's up '  the ' achievemts' on her CV and obtains another top post in the next organisation.
She is a serial failure.
And now she's been appointed ( by Hancock), to be the head of the replacement to what was Public Health England.

whatever the rights and wrongs of this particular case, it's further evidence (if any were needed) that the various organisations which are supposed to lead (SIC) horse racing in UK are NOT FIT FOR PURPOSE...it's high time that people with no baggage, no privilege and no previous employment history (paid or unpaid) with BHA, JC, RCA, ROA, ITV, SKY, RTV, RP, were given the opportunity for their voices to be heard...it's laughable (if it weren't so serious) that each party in this case accuses the other of bullying!!!  it's going to be very interesting to see the public reaction to racing once we can get back on course but I fear with increased unemployment, lower sponsorship, fewer owners/trainers/horses and god forbid courses, that the outlook is not positive and these clowns in charge of these various organisations are only going to exacerbate...sad times indeed

Has to be a fair amount of mileage in this acrimonious departure before it fizzles out.

'She' has all bar accused the inner sanctum of closing shop on any female and boardroom  presence that may profer change.

'She' may have gone off half-cocked in her approach to changing the male dominated landscape despite feeling she was part of the process to introduce changes to a very insular and male dominated 'club'.

Some people are offended by absolutely anything these days.  Back in the day, "offensive" could be substituted with "funny".  Some things are just funny.  Too many people have lost the ability to laugh at themselves, which is a shame as it's a strong personality trait.

The boss of the Jockey Club lost her job over remarks she made about Black Lives Matter, The Times has discovered.

Delia Bushell, 48, was proposing that racing should support the movement but she cited a black conservative activist who had described George Floyd as a criminal.

She was also found to have shared a tasteless meme with a sexual reference to Susan Boyle, the Scottish singer from Britain’s Got Talent.

The Jockey Club chief executive resigned at the weekend over what she claimed was a flawed disciplinary process by the business, which has accused her of bullying, racism and sharing inappropriate material.

A complaint about her had been lodged by Tom Manners, the group sales and marketing director of the main commercial racecourse organisation.

Ms Bushell accused the Jockey Club of a “deeply unpleasant stitch-up”. It said that her position was untenable after an inquiry, conducted by an employment barrister, confirmed behaviour amounting to “gross misconduct”, which she has denied.

The allegation of racism is understood to have arisen from a conversation between senior executives about how to respond to Black Lives Matter in the days after Mr Floyd’s death in May.

Ms Bushell was said to have suggested writing to all staff in support of the movement. One executive said that this might look like virtue signalling and it would be better to make actual changes.

The chief executive, who is regarded by sporting figures as supportive of diversity, then described how there had been a variety of responses to the death. She cited Candace Owens, who said that Mr Floyd, who died in US police custody, was a criminal.

The sharing of the inappropriate material happened during the lockdown when Ms Bushell and colleagues had a discussion about joke memes. She is understood to have said that she had been sent a tasteless one about Boyle and agreed to share it with others on the call.

These incidents were one-offs. The Jockey Club, though, has said that the independent review had looked at a wide range of allegations about Ms Bushell’s conduct and the board found that it was untenable for her to continue in the role she had held for a year. Racing sources have also suggested that Ms Bushell contacted witnesses before they were spoken to by Jack Mitchell, the specialist employment barrister who conducted the inquiry.

It is understood that this suggestion was disputed at the time. Ms Bushell had been invited to nominate witnesses and she spoke to one to ask if they were willing to give evidence, unaware that this might be frowned upon.

Ms Bushell said in her resignation letter that the grievance against her had come from an employee whose role was affected by a proposed restructuring.

Mr Manners, 55, from Warwick, was recruited by the Jockey Club as group brand development director in 2012 from the casino and bingo empire Gala Coral. It is understood that Ms Bushell’s expressed desire for a young and modern approach to marketing may have been regarded by employment lawyers as evidence of potential age discrimination.

Racing sources defended the Jockey Club by pointing to the extent of its inquiry, which took evidence from 19 internal and external witnesses and lasted several weeks.

The full board unanimously accepted that there was a basis for disciplinary action and Ms Bushell’s exit was being discussed when she suddenly resigned.

Ms Bushell and Mr Manners declined to comment.

Christ, what a shower! Bushell, Manners, the lot of them. They just can't seem to see a hole in the road without wanting to dive headfirst into it.

It didn't seem to occur to any of them to worry that their sport is currently vanishing before their eyes. No. Sod that. Too difficult. I know! Let's have an argument about racism instead.

I normally very sober and decent judge and insider and someone I have much time for over the years, messaged me today and strongly cautioned me against feeling sorry for Ms Bushell at all, after I put up a post sympathetic to her on Twitter. Quite the opposite was the suggestion. Rejoice!

Wow! An inference or insinuation of that ilk ie non-politically correctness can get someone sacked or forced to resign. I'd have supported Ms Bushell on bringing in someone younger with a modern approach to marketing - what is wrong with that? Big companies do that all the time; new approach stimulates new interest, etc. The sport is spiralling into an abyss, and the present souls at the JC do not seem to have picked=up on it (yet).

Dido Harding presided over the biggest "leak" of customer data at Talk-Talk, if memory serves. Talk-Talk was also one of the very worst providers of home broadband when she was at the helm.

EYEBROWS were raised last week at the choice of Dido Harding to run the new National Institute for Health Protection (NIHP), given her wretched record with track-and-trace.
But seasoned Dido-watchers weren’t surprised. For the most striking feature of this ex-jockey’s career is a talent for changing horses in mid-stream, seldom staying long enough to shoulder the blame for disasters:

1995: After a stint as a trainee management consultant at McKinsey, 27-year-old Dido gets her first proper job: marketing director, no less, at Thomas Cook. “Thomas Cook spends a long time contemplating its navel,” an exec from a rival firm tells Marketing Week. “It is in character for it to recruit a consultant rather than a doer.” Harding takes the criticism in her stride: “It is common for consultants to be thought of as eggheads who don’t know what they’re doing. I want to prove I can do things before the label sticks.”

1997: Interviewed by Travel Trade Gazette, Harding makes a virtue of her ignorance. “I am not ashamed to say I do not know the travel industry as well as my colleagues. But in a team I think I bring a new perspective.”

1998: When she was hired, Thomas Cook said Harding would “look at the future for the business in five to 10 years’ time”. But after four years she is off, moving to employment services group Manpower as “senior vice-president, strategic marketing Europe”.

1999: Time for another change of horses: Harding becomes commercial director of struggling retail group Woolworths.

2000: After less than a year she gallops off to join Tesco as “commercial director for value added foods”.

2004: She is now Tesco’s “international support director”, responsible for its overseas ventures. In 2003, Dido told the Guardian that she hopes “still to be with Tesco in five years’ time”. So, inevitably…

2007: Dido deserts Tesco for arch-rivals Sainsbury: after an obligatory few months of gardening leave, in March 2008 she starts work as head of Sainsbury convenience stores. But not for long.

2009: In December, Harding announces she will join TalkTalk as chief executive in March 2010.

2011: TalkTalk incurs a £3m fine from Ofcom for sending thousands of customers inaccurate bills. The firm has to shell out a further £2.5m in refunds. During her time at TalkTalk she twice wins the Daily Mail’s wooden spoon award for providing “the worst customer service in the UK”.

2014: Dido’s old university chum David Cameron gives her a seat in parliament as a Tory peer.

2015: Cyber-criminals access the financial and personal details of more than 150,000 TalkTalk customers. Asked if the data was encrypted or not, chief executive Baroness Harding sighs: “The awful truth is that I don’t know.” Almost 100,000 customers leave TalkTalk and profits are halved.

2017: Harding leaves TalkTalk to try her hand at “public service activities”. She becomes chair of NHS Improvement, responsible for overseeing all NHS hospitals, but tells MPs on the health select committee: “I have not worked in health and social care and would be the first to admit I have a lot to learn about the sector.” She also airily rejected the MPs’ call to resign the Tory whip while holding what should be an independent post. Then along comes Covid…

2020: Following her brief, calamitous spell as track-and-trace supremo, Lady H is to chair the new NIHP. Matt Hancock dismisses MPs’ mutterings about her lack of health credentials, assuring ITV News she has “excellent experience”. Indeed, by her previous standards three years at the NHS probably do count as a wealth of experience. With Dido on board, the NIHP can now look to the future as confidently as, say, Thomas Cook or Woolworths...

It's not what you know but who you know. And, her career is a classic case of jobs for cronies. I guess this is one occasion drifting from one job to the next has not damaged her career; the golden handshake from each of the job she's left,...that I do envy. I thought she was out-of-her-depth during the Covid briefings.

todays britain - still far too many from specific backgrounds in positions of power and influence with no discernible qualifications or talent other than manners and speaking in a certain way...wasn't the JC supposed to be moving away from this 'class' more than 20 years ago?? personally i would make the position of non-executive director illegal in all bodies/industries, worst example being remuneration committees blindly approving bonues/monumental benefits for CEOs etc and then receiving the same in return

horseracing in UK is clearly not in safe hands - oh for some proper journalists and some proper debate

The really worrying thing is that this useless prat is going to protect us all from covid.
Bushell may be no saint but if Harding is against her I am on her side.
