The battle is well underway.............despite failing to have the bent and bias Chairman of the takeover arbitration panel removed.


Mike Ashley still feels he has a very strong case that he can win and that this Newcastle United takeover can still be ‘pushed through’…

Newcastle United Official Statement:

‘NUFC v EPL public statement to be considered following publication of the two judgments:

Today the High Court handed down judgment in NUFC’s application to have the Chairman of the Arbitration Panel under the Premier League’s (‘EPL’) Rules removed from hearing its claim concerning the proposed takeover of the Club. The Club asked for the Chairman to be removed on the ground of apparent bias.

The Club made the application because two weeks after the Chairman had been appointed the lawyers representing the Premier League, Bird & Bird, disclosed information that the Club had previously been unaware of. In particular, Bird & Bird disclosed that the Chairman had provided confidential advice to the EPL in 2017.

Although the advice was not provided to the Club, the Club was informed that the Chairman had advised the EPL on amendments to its ‘Owners and Directors Test’ (‘OADT’) in Section F of its Rules. Shortly after the Chairman provided that advice in 2017 the Rules were changed to prevent a foreign owner involved in alleged broadcasting piracy from passing the test.

This information concerned the Club given the following context: in a much publicised letter to EPL clubs in April 2020, BeIN Sports called for the EPL to “strictly apply” the OADT to prevent the Saudi sovereign wealth fund, PIF, from being involved in the takeover of the Club because BeIN alleged that the Kingdom of Saudi Arabia (‘the KSA’) was involved in broadcasting piracy. Later that year, the EPL decided that the KSA controlled the PIF and was therefore a ‘Director’ under its Rules. The Club disputes this analysis and brought an arbitration to reverse the decision. As today’s Judgment records, the Club’s case is that the arbitration is wider than simply the definition of ‘Director’ and part of the Club’s challenge is to the lawfulness of the EPL’s approach when considering the takeover.

The Chairman had also failed to disclose, when he was appointed, that he had previously been appointed by Bird & Bird and, in the last 3 years, had been an arbitrator in 12 cases involving Bird & Bird. When challenged by the Club, prior to the High Court claim, the Chairman did not agree to step down. The Club’s concerns were heightened when he then engaged in unilateral communications with Bird & Bird about the Club’s challenge, which is expressly against the EPL arbitration rules. In his private emails with the EPL’s lawyers he asked if they wanted him to carry on as Chairman, and he later explained that if they had asked him to step down he would have done so. The private email exchange was only disclosed after Bird & Bird suggested it should be.

Although the Court was critical of these communications, describing them as an “error of judgment” the Court refused the Club’s application to remove the Chairman on grounds of apparent bias.

The Club is disappointed with the Court’s judgment on this issue. As noted at the end of the Judgment, the Club submitted that the Judge did not address all of the Club’s arguments. The Club is committed to the speedy and fair determination of its claim so that the proposed takeover can go ahead as soon as possible. However, it felt it had to make this application given the need for the dispute to be determined by way of a fair process. The Club is considering whether or not to pursue an appeal.

The Club argued for the hearing to be in public but lost on that argument. The Club also wanted the Judgment to be published, even though it was dissatisfied with the outcome. Meanwhile, the EPL attempted to prevent it from being published at all. The EPL said that if it was published it should be heavily redacted and anonymised so that readers would not be able to identify the dispute. Unfortunately, this is consistent with the EPL’s lack of transparency over the takeover. The Club won on this point. The Judge rejected the EPL’s arguments and said there was a “public interest” in publication of the Judgment. The Club welcomes the fact that at least its supporters, and the wider public interested in the takeover and the dispute, will now be able to have some information about the process.

The Club shall continue to actively pursue its claim in the arbitration and calls on the EPL to resolve the matter in a speedy and transparent way that does not prevent the substantial investment into English football, and the North East region, that the proposed takeover would bring.’

Club statemet:

An investment group led by the Public Investment Fund (PIF), and also comprising PCP Capital Partners and RB Sports & Media (the “Investment Group”), has completed the acquisition of 100% of Newcastle United Limited and Newcastle United Football Club Limited (“Newcastle United” or the “Club”) from St. James Holdings Limited.


All requisite approvals have been obtained from the English Premier League and the acquisition was completed on 7 October 2021.

The Investment Group is comprised of long-term, patient investors who have every confidence in the future success of the Club. Today’s announcement is the conclusion of a thorough and detailed process that has allowed the Investment Group to arrive at a deal that benefits all stakeholders and will leave Newcastle United well-placed to pursue a clear, long-term strategy.

His Excellency Yasir Al-Rumayyan, Governor of PIF, will serve as Non-Executive Chairman of Newcastle United. Amanda Staveley, chief executive of PCP Capital Partners, will have one seat on the board. Jamie Reuben will also be a director of the Club, representing RB Sports & Media.

For PIF, one of the world’s most impactful investors, the acquisition is in line with its strategy of focusing on key sectors including Sports and Entertainment, and aligns with PIF’s mission to actively invest over the long term – in this case, to harness the Club’s potential and build upon the Club’s legacy.

Commenting on the agreement, His Excellency Yasir Al-Rumayyan, Governor of PIF, said: "We are extremely proud to become the new owners of Newcastle United, one of the most famous clubs in English football.

"We thank the Newcastle fans for their tremendously loyal support over the years and we are excited to work together with them."

Amanda Staveley, Chief Executive Officer of PCP Capital Partners, said: "This is a long-term investment. We are excited about the future prospects for Newcastle United.

"We intend to instill a united philosophy across the Club, establish a clear purpose, and help provide leadership that will allow Newcastle United to go on to big achievements over the long term.

No point in much change for now.

Its a fair bet that we'll get relegated this season regardless of the takeover.If come January it looks bleak then keep the money in the bank, should we go down, retain the same squad who could get us promoted and then spend and invest. Its a long term project, and rightly so.

I think all we know is that the " fit and proper " persons test to vet owners is the biggest joke in football history. I thought when Bury fc was sent into oblivion was bad when the owner didn't even know the town had a football club but a club taken over by a mass murderer responsible for executions/ bombings/ slaughter etc.. beggars belief quite frankly. A good job the yorkshire rippers dead or he would probably be lined up for the next club.. just shows money talks in the bloated bubble of football and there are no morals left of any kind

I wrote a column about the Saudi takeover last year. Rightful anguish about football investment sources.

Uber, Disney,Facebook, Boeing, Live Nation all have Saudi investment and I've used the services of all of them.

So setting Newcastle apart would be hypocrisy.

Newcastle aren't a tiny club, they're a massive club and probably the biggest underachieving club in England considering the size of the fan base. There's a bit of a difference between share holders and owning something 100% outright but you make a fair point regarding the likes of city etc.. my own club is foreign owned also, but if we are going down this road let's scrap the fit and proper persons test completely. Incidentally I wouldn't concern yourself over what woman beating collymore has to say who as a player changed his clubs every other week with mental health issues.

If we are saying football and morality etc are not interlinked as collymore says with the former being a business such as disney/ facebook etc that's fine but I don't want to hear about BLM crap and rainbow laces for players as the hypocrisy would be mind blowing. Either the ownership of the club is irrelevant and we separate football from other things in life and stop bringing politics/ sexuality/ racism into the game or we apply all things equally.. for the likes of collymore to be crying about racism incessantly with knee taking then to have the audacity to support owners who butchered other races is laughable

all i will say to wolf is i believe hes a Wolves fan - went down there 2015/2016c on a max n paddy job returning a 72k camper home fo one of my pals - had to drop one off pick two up 3o odd miles away to bring back to Eldiss Consett if any1 needs approval lol- anyway long story wheres toon training ground first person wuda telt ya - we asked 20plus persons around Wolves who clearly didnt giv a donald - ended up phoning wolves club hotline to get answer

I don't particularly blame the hanger ons and the general football fan. the hanger ons see an opportunity to get their youtube subs up and thus make money, and the general football fan is pretty thick with zero brain cells between them, so they think naturally their going to be successful and its an opportunity to gob off at the enemy (Sunderland), its all basic tribal b0llocks with them.

But I find it slightly annoying how easy it is to push their buttons, 3 months ago the media were getting them all hot and mouthy about Saudi Arabia being against human rights and minority rights in general, didn't the Saudi lot cut up a bloke last year?, to which the same types were going off about?... fast forward a year and their all wearing blankets and pretending to ride a camel... you have to just chuckle otherwise you'd kill someone through insanity.

I've noticed a lot of smaller club channels are giving up because they can't get the exposure from being a supporter of a small club

Youtube wont give exposure to a club like Barnsley for example so their channels just can't grow, that's why most of them are desperate for their clubs to reach the prem ffs

Its all about being in the little club for most of them, hence why certain channels are jumping on this because its gaining them an extra 10,000 subs for example

Just tell the utter t*ats to pretend to support City/Chelsea and if they've got a bit of charisma and bulls*it skill, the gullible will lap it up and sub

One of the claims made over the failed takeover is that the Premier League’s Big Six – Manchester United, Liverpool, Manchester City, Arsenal, Tottenham and Chelsea – played a role in a potential deal stalling.

And one of the revelations is that Spurs objected to the takeover despite having tried to get the Saudi royal family to buy them in a £.5billion deal themselves last year.

But we have seen information that explains why there is the obsession with Project Big Picture and why there is such a determination to stop PIF investing in Newcastle United.

“Tottenham Hotspur, in a negotiation which broke down in March 2019, approached investors in the region we are talking about – two months before the Newcastle deal was ironed out – to buy the football club for £2.5billion, with a further £1billion in add ons.

The first three years will be underwhelming in my opinion. We can wait. Getting rid of the Fat Controller has taken a long time, whatever the future brings it will be better than his 14 year tenure.


Not many comments on the politics involved revolving around the FA being put under pressure by the likes of Arsenal, Man City, Spurs and Liverpool to not allow the take over to happen? Surely this should be of interest? Are these clubs going to get away with trying to dictate to us which teams in the PL can be owned by who? Surely these clubs should be brought to heel?
