A judge who called a racist defendant ‘a bit of a c***’ in court is being investigated after people apparently complained about her language.
Judge Patricia Lynch QC was sentencing 50-year-old John Hennigan at Chelmsford Crown Court for his ninth breach of an ASBO in 11 years, when he called her a ‘bit of a c***’ in the dock.
The QC responded: ‘You are a bit of a c*** yourself. Being offensive to me does not help.’
When Hennigan shouted back ‘Go f*** yourself!’ she replied: ‘You too.’
She then jailed him for 18 months for racially abusing a black Caribbean mother in Harlow, Essex.
It's a breath of fresh air to hear a story like this being reported, and fair play to her. I thought it was a great reply.
She needs congratulating, not investigating imo. It's a breath of fresh air to hear a story like this being reported, and fair play to her. I thought it was a great reply.
Her colleagues should take a leaf out of her book.
How many times have we read stories where a judge has let a paedo off because a nine year old girl has dressed provocatively? Or other such ludicrous rulings?
The whole profession needs bringing into the 21st century.

She was merely treating him with contempt. Her final comment of "We're all impressed, take him down" was excellent. She made him look like the tw4t he is.

i disagree with this judge`s behaviour . Its quite a precedent she has set herself and will she be inclined to maintain it, regardless of the nationality and religion and race of the defendent.
It would be interesting to know.

If i should hear of just such a case, whereby this judge, or even any British judge should use such language when the defendent is not British, white christian? ..
well then i might be a little more impressed.

but make no mistake the precedent has been set for British judges, we do not expect anything less in future. all defendents must receive the same intemperate response, even those who may not be British and white and christian. lets see who is the next example.

You're missing the point ebul, she was merely turning the tables on him and repeating what he said. Was done to take the wind out of his sails and it worked. Different had she used that type of language gratuitously.

But she cannot use that sort of language herself in court,
She could have fined him for contempt of court for using that language, and then herself
We do need some rules here
I see that akabulaBut she cannot use that sort of language herself in court,She could have fined him for contempt of court for using that language, and then herselfWe do need some rules here
Otherwise we would just end up with people just slanging each other in court whenever they feel like it,
Using this as a precedent.
Fair enough, but we cannot have that in courtThere are rules, they are importantOtherwise we would just end up with people just slanging each other in court whenever they feel like it, Using this as a precedent.
Probably the wrong words to use but at least a judge who seems to understand the level of response you sometimes have to use back to those standing in the dock in words they will comprehend

Ebul it wasn't a slagging match. She was very calm and controlled. He was acting like the idiot he is and shouting and banging on the glass screen he was behind.
As an aside have a look at him and his history. The lowest of the low.

surely they should just use the power they have & say because of your lack of respect instead of giving you the 1 year i was going to i'll now be giving you 18 months?
Job done/last laugh?

Good on the Judge imo, showing she's human while making the toerag out to be what he was. btw, I don't see the issue about what race/creed/beliefs the c*** possessed.
If someone spoke to me like that whatever my job or position, I would quite probably responded as the judge did. She was calm and spoke to him in his own language.

What if the defendant continued to use abusive language to the judge in court? She replies in kind, so we now a judge and defendant both slagging each other off in a court of law.
This brings justice into disrepute.
She could have the stopped the defendant by threatening him with contempt of court, say 3 months in prison. But having used the same language herself, she has constrained herself from doing this.
She should have used the contempt of court threat to start with, every time the defendant swore at her, she added 3 months to his sentence, he will soon stop, otherwise he is likely to be spending the rest of his life in prison.
The judge could have used her very apt responses outside of court, but not in court
I rest my case
Let me put this another way..What if the defendant continued to use abusive language to the judge in court? She replies in kind, so we now a judge and defendant both slagging each other off in a court of law. This brings justice into disrepute. She coul
Why is everything nowadays blown out of all proportion? Those in charge of her should have come out immediately in her defence and said the matter was concluded, end of.
Agree with akabula and studyform. Why is everything nowadays blown out of all proportion? Those in charge of her should have come out immediately in her defence and said the matter was concluded, end of.
I well understand your feelings annie, but in court everything must be decided by LAW, nothing else.
It is not a reality show, the judge will only be admonished, nothing serious I think

The Judge is in contempt of court.....she should be punished !
...and as she should know better, the sentence should be much stiffer than for a mere mortal.

studyform in his usual dishonest way pretending not to understand what race and nationality and religion mean in relation to this case.
there has never been a case where a British judge has spoken in this manner to someone who was not a white British christian.
and why not, because she would fear for her job, or worse.
now i have tried to make that as simple as possible for Studyform... no doubt he will play the innocent again

How do you know that there has never been a case where a British judge has spoken in this manner to someone who was not a white British Christian? (Why do you consistently write 'christian' by the way? You should show more respect!)
Also, do you have any other examples of British judges calling c***s like this bloke, a c***?

yes mikael, i did not use a capital `c`. dreadful but then civility is not welcome as far as i am concerned, because then i would have to show the corresponding civility to this judge. that is just what i would prefer to avoid. do i admire her for what she has done, i don`t for the reasons i have given.
and also there have been no other cases, as far as i know, there may have been and they have failed to be reported on but i should not imagine it happens everyday.

There is only one way out of this sticky situation....
In future, whenever she passes sentence, her words must be in the following format.....e.g.
'I sentence you to 2 years imprisonment. You are a bit of a c***' 'I sentence you to 12 month imprisonment, suspend for 18 months. You are a bit of a c***' etc

however we live so close together we would not survive a single day without proper rules for getting along manners are a must for society, no question about it.

I'm not, nor have I ever been, dishonest. What I'm also not - unlike some - is a bit thick. It's never wise, lfc, to assume anything. You assume loads!

Sorry Studyform, i didn`t mean that as a comment or reference to you, it was more a reflection on leftists in general. It was stupidly worded, apoligies to yourself.

Okey dokey. Accepted. Although,as I said at the top of my "been a while" thread. Being PC or diversity driven has nothing to do with being 'leftist' nor does agreeing (or not) with any given point give people a direction. Leftism seems to be a sort of insult I don't quite get.

One thing that chit chatters have not mentioned about this is that being a woman and a professional woman at that, she has probably never been called a c*** in her life and to a woman being called THAT word would have been extremely hurtful and distasteful. It is the worst word you could ever call a woman and it must have really shocked her.
As to chit chatters that want her blood I say get a life. The law is about justice and what is the justice in harming the career of a woman that only replies to the worst insult a woman can receive. She may not have been correct, but heigh ho no one is perfect. Again I say this has been blown out of all proportion, like everything else today in this politically correct, free speech not allowed world we now live in.

I don't think she responded in temper Annie in fact I'm sure she didn't. She may have been shocked by his comments but she failed to react in the way he probably hoped for. Her response was measured and calmly executed.

I don't think she responded in temper either, akabula. As you say she was calm and handled the matter well, I think. She maybe should not have replied like that, but again we are not perfect and in replying to him in the same way is not the same as she telling him him first without provocation.
I thought that too, terry, but I doubt that there have been many that would anger a judge and the law with that word.

akabula • August 15, 2016 10:14 PM BST I think people are overreacting to what was a Judge showing an idiot that he was wasting his time with his nonsense.
I would not disagree with that. But there is a question of LAW here. Also how on earth do you expect people in court not to use this sort of language, when the Judge herself is?

She let him get to her Makybe, he was offensive, he is an offensive man, why he was in court.
The Judge is impartial, in terms of sex and everything else, and has to remain above this.
She let herself down as you say.
